Aquesta normativa defineix els requisits reglamentaris, com les superf\u00edcies i caracter\u00edstiques m\u00ednimes, el proc\u00e9s d&#8217;autoritzaci\u00f3 de les empreses gestores i el registre detallat dels coworkings.<\/p>\n<p style=\"text-align: justify;\">A m\u00e9s, permet que els comer\u00e7os d\u2019activitats de despatx d&#8217;oficina es puguin registrar en aquests espais, alliberant aix\u00ed pisos destinats a aquest \u00fas i retornant-los al mercat de lloguer. Les empreses actuals disposaran de sis mesos per adaptar-se a la normativa, amb l&#8217;objectiu de fomentar un ecosistema empresarial innovador que reforci la competitivitat d&#8217;Andorra.<\/p>\n<p style=\"text-align: justify;\">Us presentem a continuaci\u00f3 un resum destacat del <strong>Reglament<\/strong>:<\/p>\n<p style=\"text-align: justify;\"><strong>-Superf\u00edcie m\u00ednima:<\/strong><\/p>\n<p><u>1. Escriptori m\u00f2bil o hot desk:<\/u><\/p>\n<ul style=\"text-align: justify;\">\n<li>Espai compartit de treball<\/li>\n<li>Professionals que NO necessiten espai permanent<\/li>\n<li>NO requereix reserva pr\u00e8via<\/li>\n<li>Superf\u00edcie m\u00ednima 7m2 (espai privat i com\u00fa)<\/li>\n<\/ul>\n<p><u>2. Escriptori fix o dedicated desk:<\/u><\/p>\n<ul style=\"text-align: justify;\">\n<li>Espai compartit de treball<\/li>\n<li>Professionals que SI necessiten espai permanent<\/li>\n<li>SI requereix reserva pr\u00e8via<\/li>\n<li>Superf\u00edcie m\u00ednima 7m2 (espai privat i com\u00fa)<\/li>\n<\/ul>\n<p><u>3. Oficina privada<\/u><\/p>\n<ul style=\"text-align: justify;\">\n<li>Espais independents reservats a empreses o equips de treball<\/li>\n<li>Espai restringit a resta d\u00b4usuaris \u2013 acc\u00e9s nom\u00e9s usuaris de l\u00b4oficina privada<\/li>\n<li>Superf\u00edcie m\u00ednima 7m2 (espai privat i com\u00fa)<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>-Caracter\u00edstiques m\u00ednimes:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>Escriptori<\/li>\n<li>Cadira<\/li>\n<li>Llum i acc\u00e9s a endolls de llum<\/li>\n<li>Acc\u00e9s a internet per cable o wifi.<\/li>\n<li>Acc\u00e9s a espais comuns, com WC, espai destinat a cafeteria, menjador, sala de reunions, etc..<\/li>\n<li>Acc\u00e9s a instal\u00b7lacions d\u00b4impressi\u00f3 o servei d\u00b4impressi\u00f3<\/li>\n<li>Armariets, calaixos o armaris al mateix espai<\/li>\n<li>Neteja i manteniment dels espais<\/li>\n<li>Climatitzaci\u00f3<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">*En el cas d\u00b4oficines privades; a m\u00e9s a m\u00e9s, acc\u00e9s restringit a l\u00b4espai mitjan\u00e7ant claus o sistemes d\u00b4identificaci\u00f3.<\/p>\n<p style=\"text-align: justify;\"><strong>-Procediment d\u00b4autoritzaci\u00f3:<\/strong><\/p>\n<p>1. Qui pot demanar-ho?<\/p>\n<p style=\"text-align: justify;\">Empreses d\u00b4explotaci\u00f3 d\u00b4espais compartits de treball o coworking (EECC) amb car\u00e0cter professional. Exploten serveis d\u00b4espais compartits i s\u00f3n propiet\u00e0ries o titulars de drets d\u00b4us o explotaci\u00f3.<\/p>\n<p style=\"text-align: justify;\">Persona f\u00edsica o jur\u00eddica, pot presentar sol\u00b7licitud d\u00b4autoritzaci\u00f3 administrativa per a EECC<\/p>\n<p>2. Documentaci\u00f3 requerida:<\/p>\n<ul style=\"text-align: justify;\">\n<li>C\u00f2pia de l\u00b4escriptura o certificat notarial que identifiqui el propietari dels espais compartits de treball o coworking on consti adre\u00e7a i superf\u00edcie total dels espais.<\/li>\n<li>C\u00f2pia del contracte de gesti\u00f3 dels espais de treball compartit o coworking, o c\u00f2pia de document acreditatiu d\u00b4\u00fas.<\/li>\n<li>Pl\u00e0nol amb detall de la capacitat m\u00e0xima dels espais que formen els espais compartits i de la seva distribuci\u00f3 (Global i individualitzada) indicant per tipologia d\u00b4espai. (hot desk, dedicated desk, oficina privada)<\/li>\n<li>Declaraci\u00f3 jurada que els espais compleixen amb els requisits establerts.<\/li>\n<li>Certificat asseguran\u00e7a RC que acrediti que els espais compartits tenen contractada p\u00f2lissa RC per danys a tercers en un quantia suficient per cobrir danys eventuals d\u00b4acord amb la capacitat declarada a la sol\u00b7licitud.<\/li>\n<li>C\u00f2pia del document que la persona f\u00edsica que formalitza la sol\u00b7licitud t\u00e9 capacitat de representaci\u00f3 de la persona f\u00edsica o jur\u00eddica sol\u00b7licitant.<\/li>\n<\/ul>\n<p>3. Resoluci\u00f3:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Un cop entrada i revisada la sol\u00b7licitud en cas de back office ministeri atorga 10 dies h\u00e0bils per solventar-ho.<\/li>\n<li>Termini m\u00e0xim de 2 mesos per resoldre sol\u00b7licitud. Si no s\u00b4obt\u00e9 resposta transcorregut el termini, s\u00b4ent\u00e9n per denegada.<\/li>\n<li>En cas desfavorable, es pot presentar recurs.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">4. Contingut de la resoluci\u00f3<\/p>\n<ul style=\"text-align: justify;\">\n<li>Nom de la EECC<\/li>\n<li>Adre\u00e7a de la EECC<\/li>\n<li>Mail de la EECC<\/li>\n<li>Si els espais compartits que explota la EECC son titularitat diferent de la EECC, dades de la propietat<\/li>\n<li>Identificaci\u00f3 dels espais compartits<\/li>\n<\/ul>\n<p>5. Vig\u00e8ncia:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Autoritzaci\u00f3 \u00e9s indefinida<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>-Registre d\u00b4espais comuns complementaris i espais compartits de treball<\/strong><\/p>\n<p>1. Funcions<\/p>\n<ul style=\"text-align: justify;\">\n<li>Qualificar i resoldre actes inscriptibles<\/li>\n<li>Inscriure els actes que estableix la llei<\/li>\n<li>Donar publicitat i certificar els actes inscrits<\/li>\n<li>Altres tasques atribu\u00efbles<\/li>\n<li>Registre t\u00e9 car\u00e0cter p\u00fablic<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>-Altres dades d\u00b4inter\u00e8s:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>En el sup\u00f2sit que un espai compartit canvi\u00ef de titular, el nou titular ha de regularitzar les dades en el termini d\u00b41 mes a partir de la data de canvi de titularitat.<\/li>\n<li>Qualsevol canvi que afecti les dades del registre han de ser notificades en el termini d\u00b41 mes a partir de la data de canvi<\/li>\n<li>El n\u00famero d\u00b4inscripci\u00f3 al registre ha de constar obligat\u00f2riament en tota mena de suports on s\u00b4anunci\u00ef o promocioni l\u00b4espai compartit.<\/li>\n<li><strong>La placa oficial facilitada per Govern ha d\u00b4estar en lloc visible a l\u00b4espai.<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>-Obertures de comer\u00e7:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>En oficina privada: En una oficina privada nom\u00e9s es pot radicar 1 comer\u00e7<\/li>\n<li>Les autoritzacions d\u00b4obertura de comer\u00e7 de tercers nom\u00e9s s\u00b4atorguen per activitats de despatx o oficina<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>-Termini de regularitzaci\u00f3:<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>Termini de 6 mesos perqu\u00e8 les persones f\u00edsiques o jur\u00eddiques que actualment exploten espais compartits compleixin reglament<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Adjuntem enlla\u00e7 del <a href=\"https:\/\/www.bopa.ad\/Documents\/Detall?doc=GR_2024_06_20_15_35_17\" rel=\"nofollow noopener\" target=\"_blank\"><strong><em>Reglament al BOPA<\/em><\/strong><\/a>.<\/p>\n<p style=\"text-align: justify;\">Si necessiteu m\u00e9s informaci\u00f3 o assessorament, no dubteu a posar-vos en contacte amb nosaltres a trav\u00e9s de l\u2019email andorra@addwill.eu o el tel\u00e8fon +376 833 333.
